Driving While Intoxicated

At approximately 12:25 a.m. on Jan. 28, Officer Frank Acocella was dispatched to the area of Purchase Street and Kenilworth Road for a reported erratic driver. Upon arrival, he noticed a vehicle pulled off the road with a female operator and an off-duty Rye Police Officer. Rye Police Officer Anthony Rosace stated the vehicle operate crossed the double yellow line and nearly struck his vehicle before turning onto Kenilworth Road and pulling over. 

Acocella walked to the vehicle and the driver was sitting in the driver's seat with the engine running. Upon speaking with her, he detected a strong odor of alcoholic beverage from her breath, as well as blood shot eyes and slurred speech. He asked the defendant to exit the car and walk to the rear of her vehicle. Acocella asked if she'd been drinking, and she replied she'd had three to four drinks.

The driver, who was identified as Kimberly Mule, 39, from Hawthorne N.Y., said she was willing to perform a sobriety test. She performed one test, and Acocella determined it was unsafe for her to continue with the other tests after she lost her balance and grabbed onto the vehicle to keep herself from falling.

Mule was placed under arrest for Driving While Intoxicated and chemical tests showed her Blood Alcohol Content was .25.

Marijuana Possession

At 3:39 a.m. on Jan. 25, Officer Sokol Biberaj noticed a vehicle traveling southbound on Lake Street with no headlamps. He pulled the car over, and requested the operator's driver's license, registration and insurance card. Upon doing so he noticed a strong odor of marijuana from the car's interior. He asked the operator how much marijuana he had smoked. The driver, later identified as26-year-old Diego Vela of Port Chester, N.Y., replied, "Sorry Officer, I just like to smoke weed."

Biberaj asked Vela if there were any drugs in the car, and he said he had some in his pocket. Biberaj then asked him how long ago he had smoked and Vela stated he'd smoked around 1 a.m. at his friend's house. After asking him to hand over the drugs, Vela retrieved a clear plastic bag containing three glassine bags of alleged marijuana from his pocket. Vela was released with a return court date of Feb. 9. He left the scene in a sober state and was allowed to drive home.

Suspended registration

At 10:42 a.m. on Jan. 26, Officer Frank Milone was on patrol in the area of 260 Halstead Ave., when he observed a vehicle parked unoccupied with the ignition keys still in the ignition. He observed a man walking towards the vehicle, and asked him if he was the operator. He states he was. Milone asked the operator for his license, registration and proof of insurance. A radio check showed that the driver, identified as 40-year-old Edgar Bolanos of Mamaroneck, N.Y., had a suspended registration for an insurance lapse. His license was valid.

Clarks Towing responded and the vehicle was impounded. Two New York State license plates were removed and given to Bolanos who was released from the scene with a return court date of Feb. 2.

Suspended license

At 5:45 p.m. on Jan. 26, Officer Richard Abbate was on patrol when he noticed a vehicle operating with only one headlamp. He activated his emergency lighta and pulled the vehicle over for a traffic stop. The operator was identified as 28-year-old Carly Plymel of Harrison, N.Y.. Plymel stated she had an expired license.

A DMV check of Plymel revealed that her driving privleges are suspended in New York State due to her failure to answer a fine out of the City of White Plains. Abbate placed Plymel under arrest and secured her in the back of his police vehicle. She was processed without incident and transported to her residence where she was released with a return court date of Feb. 2.
